Alberto Del Rio was charged with kidnapping and sexual assault after his ex-fiancé accused him of atrocious acts. She has since recanted her statement, but the trial will press on.

Cageside Seats’ Shakiel Mahjouri recently spoke to Alberto Del Patron about his ongoing legal issues. He explained that the charges were already dropped as his ex-fiancé “has already withdrawn her charges. He has already talked to the DA’s [District Attorney’s] office and told them the truth. She apologized and gave us a public apology and everything.”

Although the charges have been dropped and she withdrew her complaint, that doesn’t matter to the court system. Del Rio explained that they will still have to go through court and have it officially dropped before this legal situation can be behind him.

“It doesn’t matter. When it comes to cases like that, especially with the women’s movement and everything going on when it comes to family law, it doesn’t matter if I drop the charges or she drops the charges. The state follows it and it doesn’t end until the state says that it’s over,” he says. “It doesn’t matter if someone goes and drops the charges. It’s up to the state to decide when this is over. To me, I just respect the law in the great state of Texas. To me, it shouldn’t be like that.”


Del Rio said that “everything is looking good” in his case, but the trial is still pending. This case was likely subject to a massive delay in the legal process due to so many cases getting clogged up in the system after the COVDI-19 pandemic caused such an issue with the legal system.
