AEW has been involved in a legal battle featuring Luchasaurus’ mask for a while now. There has been a lot of development on the ongoing case so far. Now it seems Luchasaurus’ lawyers submitted a motion to dismiss the complaint.

As previously reported on December 20 that Composite Effects LLC had filed a legal complaint against AEW and wrestler Austin Matelson Luchasaurus) alleging that the design of the Luchasaurus mask is protected by copyright and that it is being used for merchandise without the designer’s permission.

AEW then had moved to dismiss five of the six counts raised by Composite Effects. According to Wrestlenomics, Judge Fallon approved the filing into the record of CFX’s amended complaint on March 24.

Matelson’s lawyers submitted a motion back on April 7th to dismiss the complaint over a failure to state a claim. They noted that CFX fails to plausibly allege that the modified versions of the Luchasaurus mask aren’t “substantially similar” to the “Viper Silicone Mask” that CFX claims as its copyright.

Substantial similarity is defined, according to the attorneys who cite case law, as a similarity by which “an ‘ordinary observer, unless he set out to detect the disparities, would be disposed to overlook them, and regard [the] aesthetic appeal as the same.”

The ongoing lawsuit between Composite Effects, AEW and Luchasaurus is certainly far from ending anytime soon by the looks of it. We will keep you updated on this ongoing legal case right here at Ringside News.
